California Paid Family Leave Eligibility: What EDD Reviews

EDD decides eligibility after reviewing a filed claim

You may be eligible for California Paid Family Leave when you cannot perform your regular work, lose wages because of qualifying family leave, are working or looking for work when the leave begins, and earned at least $300 in your base period with State Disability Insurance withheld.

Meeting the general requirements does not approve a claim automatically. EDD tells people who think they may qualify to file a claim so the department can make the determination.

Three qualifying reasons for family leave

Bond with a new child

Leave may involve a child joining the family through birth, adoption, or foster-care placement. Bonding benefits must be used within the child’s first year with the family.

Care for a family member

The family member must have a serious health condition, and the claim requires the care recipient’s statement and medical certification.

Military assist

Leave may support a family member in the US Armed Forces during a qualifying deployment and requires supporting event documents.

Work, wages, and State Disability Insurance

  • The leave must cause a wage loss. PFL replaces part of eligible wages; it is not full salary continuation.
  • EDD looks for at least $300 in base-period earnings with State Disability Insurance deductions, usually shown as CASDI on a paystub.
  • EDD calculates a potential weekly benefit using the highest quarter of earnings in the applicable base period.
  • Part-time or reduced-hours work does not automatically prevent eligibility when the claimant loses wages and meets the other requirements.

Report sick leave, paid time off, vacation pay, wages, and other employer payments accurately. Other income can affect the weekly amount EDD issues.

Situations that do not automatically disqualify someone

  • Citizenship and immigration status do not affect PFL eligibility.
  • Living outside California does not by itself prevent eligibility when the job is based in California, CASDI was withheld, and the other requirements are met.
  • A worker who believes an employer misclassified them as an independent contractor can still apply and let EDD evaluate the claim.
  • Working part-time may still allow benefits for the wages lost during qualifying family leave.

Deadlines and supporting documents still matter

File no earlier than the first day family leave begins and no later than 41 days afterward to avoid losing benefits. Bonding, care, and military-assist claims require different supporting documents. An otherwise eligible person can experience delays or a denial when the application is late or incomplete.

PFL pay and job protection are different

EDD administers PFL wage-replacement benefits. PFL itself does not provide job protection; separate state or federal leave laws may apply. Ask the appropriate government agency or a qualified professional about employment-law rights.
